2. Scope of these conditions

These conditions apply to online purchases and, where applicable, reservations or services contracted through www.flistonbikerent.com.

By completing an order, the customer confirms that the information provided is correct and that they have had the opportunity to read the applicable conditions before entering into the contract.

Mandatory consumer rights established by Spanish and European Union law always prevail over any contractual provision contained on this website.

3. Prices and payment

The prices applicable to an order are those displayed during the purchasing process at the time the order is placed.

The final amount, applicable taxes, delivery charges and any other costs, where applicable, will be displayed before the customer confirms payment.

4. Right of withdrawal for online purchases of goods

Except where a legal exception applies, consumers who purchase goods online have the right to withdraw from the contract within 14 calendar days without having to provide a reason.

In the case of goods, the withdrawal period generally begins on the day on which the consumer, or a third party indicated by the consumer other than the carrier, acquires physical possession of the goods.

Where several goods from the same order are delivered separately, the withdrawal period may begin when the final item is received, in accordance with the applicable legislation.

Exercise your right of withdrawal online

If you wish to withdraw from an eligible online purchase, you can submit your request electronically using our dedicated withdrawal form.

Withdraw from a purchase

Submitting a withdrawal request does not automatically cancel the order or issue an immediate refund. Your request will be recorded and processed in accordance with the applicable consumer legislation.

5. Other ways to exercise your right of withdrawal

The online form is provided as an easy method of exercising the right of withdrawal. Where the right applies, consumers may also communicate their decision through another clear and unequivocal statement.

You may contact us at: flinstonbike@gmail.com .

Your communication should include sufficient information to identify you and the relevant order, for example:

  • Your full name.
  • Your email address.
  • Your order number.
  • The product or products concerned.
  • A clear statement that you wish to withdraw from the contract.
Example:
“I hereby give notice that I wish to withdraw from my contract for the purchase of the goods corresponding to order number [ORDER NUMBER].”

6. Returning goods after withdrawal

After notifying us of the decision to withdraw, the goods must be returned within the period established by applicable consumer law.

Before sending a return, we recommend contacting us so that we can provide the appropriate return instructions.

Unless otherwise indicated or legally required, the consumer is responsible for the direct cost of returning goods following a voluntary withdrawal.

This does not apply where the goods are defective, damaged, incorrectly supplied or where Fliston Bike is legally responsible for the return costs.

The consumer may be responsible for any reduction in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

7. Refunds

Where a valid right of withdrawal is exercised, the amounts that must legally be reimbursed will be refunded without undue delay and within the statutory period.

Unless another method has been expressly agreed, the refund will normally be made using the same payment method used for the original transaction.

Additional delivery costs resulting from the customer’s choice of a delivery method more expensive than the least expensive standard delivery option offered by us are not required to be refunded.

For sales of goods, the refund may be withheld until the returned goods have been received or until the consumer provides evidence that the goods have been sent back, whichever occurs first, where permitted by law.

8. Exceptions to the right of withdrawal

The statutory right of withdrawal does not apply in certain cases established by consumer legislation.

Examples may include, where legally applicable:

  • Goods made to the consumer’s specifications or clearly personalised.
  • Sealed goods that are not suitable for return for health protection or hygiene reasons when they have been unsealed after delivery.
  • Digital content supplied in circumstances in which the statutory right of withdrawal has been lost following the consumer’s prior express consent and acknowledgement.
  • Services that have been fully performed where performance began with the consumer’s prior express consent and the legal requirements for loss of the right of withdrawal have been satisfied.
  • Other contracts expressly excluded from the right of withdrawal under applicable Spanish or European Union consumer legislation.

9. Bike rental, tours and services booked for specific dates

Fliston Bike provides bike rental and other services, including activities that may be booked for a specific date or period.

Consumer legislation provides specific rules and exceptions for certain services, particularly services or leisure activities arranged for a specific date or period.

Consequently, the statutory 14-day withdrawal right applicable to the online purchase of goods should not be assumed to apply automatically to every rental, tour, activity or dated booking.

Where a statutory exception applies, this does not affect any additional cancellation rights that Fliston Bike may expressly offer to the customer as part of the booking conditions.

Important: Cancellation of a booking and exercise of the statutory right of withdrawal are not necessarily the same legal concept.

10. Services started during the withdrawal period

Where a consumer expressly requests that a service begin during an applicable withdrawal period, the legal consequences established by consumer legislation will apply.

Depending on the circumstances, the consumer may be required to pay an amount proportional to the part of the service already provided before withdrawal.

Once a service has been fully performed, the right of withdrawal may cease where all statutory requirements, including the required consent and acknowledgement from the consumer, have been satisfied.

11. Incorrect, damaged or defective goods

The right of withdrawal is separate from the consumer’s statutory rights where goods are defective, damaged, incorrectly supplied or do not conform to the contract.

If you believe that a product supplied by us is defective or incorrect, please contact us as soon as possible and provide the order number together with a description of the issue.

Exercising your statutory rights in relation to defective or non-conforming goods does not require you to use the withdrawal procedure.

12. Order cancellation before dispatch

If you wish to cancel an order before it has been dispatched or before the booked service has started, please contact us as soon as possible.

Where cancellation is possible, we will inform you of the available options. This contractual cancellation procedure is separate from any statutory withdrawal right that may apply.

13. Personal data

Personal data provided in connection with orders, returns and withdrawal requests will be processed for the purpose of managing the contractual relationship, complying with legal obligations and responding to the customer’s request.

Further information is available in our Privacy Policy .

14. Applicable law and consumer rights

These conditions are governed by Spanish law and applicable European Union consumer legislation.

Nothing in these conditions limits any mandatory rights that a consumer may have under applicable consumer protection legislation.

Any dispute will be subject to the competent courts and authorities determined by applicable consumer law.
